Terms and conditions
Last updated: 23 October 2026
These Terms & Conditions apply to the website at itraindrivertraining.com and to enquiries, bookings and training services supplied by Thomas Hezekiah trading as I Train Driver Training (ABN 88 032 397 093) (referred to as iTrain, we, us or our).
Please read them together with your booking confirmation, any applicable course or enrolment information, and our Privacy Policy.
1. Our services
iTrain provides heavy vehicle driver training and related services in Queensland, including training for heavy rigid (HR), heavy combination (HC) and multi-combination (MC) vehicles, subject to current availability. We may also advertise other services that are planned or offered from time to time. Only services expressly confirmed by us are included in your booking.
Information on our website is general information. The specific vehicle class, transmission type, training location, dates, duration, inclusions, price and any government test arrangements will be stated in your quotation or booking confirmation.
2. Nationally recognised training and RAISE Training
Where advertised, MC training and assessment for TLIC4006 – Drive multi-combination vehicle is delivered by iTrain on behalf of RAISE Training, Registered Training Organisation (RTO) 91655. RAISE Training is the RTO responsible for applicable nationally recognised training, assessment and issuing eligible Statements of Attainment. iTrain is not representing itself as a separate RTO.
For a nationally recognised course, learners may also need to accept RAISE Training's current enrolment requirements, learner information, assessment arrangements, complaints and appeals processes and refund policy. These will be made available as relevant before enrolment. The parties responsible for collecting fees and making enrolment, assessment and refund decisions will be identified to the learner. You can read RAISE Training's Terms & Conditions.
3. Eligibility and learner declarations
Before booking or undertaking training, you must provide accurate information about your current licence class, licence history, relevant conditions or restrictions and eligibility for your intended upgrade. You must hold a valid licence that authorises you to undertake the relevant supervised training and comply with applicable Queensland licensing requirements.
For example, Queensland generally requires an applicant upgrading to MC to have held an HR or HC licence for at least 12 months. Other eligibility, identity, enrolment and medical requirements may apply. You are responsible for verifying that you meet the requirements for your circumstances with the Queensland Department of Transport and Main Roads (TMR) and, where relevant, the RTO.
If your eligibility or information is incomplete or incorrect, training, assessment or licensing may need to be delayed or cancelled. Any fee outcome will be handled under these terms, the disclosed booking conditions, applicable RTO requirements and Australian Consumer Law.
4. Bookings and confirmation
An enquiry or requested date is not a confirmed booking. A booking is confirmed when we notify you of the agreed training details and any payment or enrolment requirements have been met.
Please review your confirmation and tell us promptly if the course type, licence class, transmission, location, date, name or other details are incorrect. Training and test appointments are subject to trainer, vehicle and, where relevant, TMR or RTO availability.
5. Fees, deposits and payments
The quoted or confirmed price will identify the service and what is included. Payment amounts, due dates, any required deposit and accepted payment methods will be communicated before you commit to a paid booking.
Unless the quotation expressly includes them, TMR fees, licence application fees, additional assessment attempts, additional lessons, travel or accommodation costs and third-party charges are not assumed to be included. We will disclose any additional iTrain charges before you agree to them.
Any card-processing surcharge, if charged, will be disclosed before payment and must comply with applicable law. If a payment is overdue, we may delay an unprovided service after giving reasonable notice, subject to applicable consumer rights and any RTO requirements.
6. Cancelling or rescheduling a booking
Please contact us as soon as possible if you need to cancel or change a booking. We will explain available alternative dates, where practicable.
Any minimum notice period, cancellation charge, rescheduling charge or deposit condition applying to your particular booking must be clearly disclosed before you confirm and pay. A charge will be applied only where lawful and appropriate to the circumstances, taking into account services supplied, reasonable costs incurred and any opportunity to reallocate the booking. There is no automatic 'no refunds' rule.
Where a nationally recognised RAISE Training course is involved, the applicable RTO enrolment and refund processes may also apply. Nothing in this clause limits rights under the Australian Consumer Law.
7. If we need to change or cancel training
We may need to delay, relocate or reschedule training or assessment because of unsafe weather, road conditions, instructor illness, vehicle faults, mechanical breakdown, regulatory requirements, government test cancellations or other events affecting safe delivery.
If we cannot supply a booked service as agreed, we will discuss a suitable rescheduling option or a refund for services not supplied, as appropriate in the circumstances and as required by law. We will communicate material changes as soon as reasonably practicable.
8. Attendance, identification and fitness to drive
You must arrive at the agreed location on time, with your current driver licence and any other identification, safety equipment or documents that we or the RTO have advised you to bring.
You must be medically and physically fit to drive safely and must tell the trainer about any condition, impairment, fatigue or medication effects that may affect your safe participation, to the extent relevant to safety. You must not participate under the influence of alcohol or drugs that impair driving. You must comply with licence conditions and lawful directions.
If you are late, absent, unable to provide required documents or unfit to train safely, we may be unable to run all or part of the session. Any rebooking or fee consequences will depend on the reasons, the terms disclosed at booking and applicable law.
9. Safety, conduct and use of vehicles
During practical training you must follow reasonable instructions from your trainer, operate the vehicle safely, use required safety equipment and comply with road rules, fatigue obligations and safety procedures.
We may stop a lesson or assessment where continued operation presents a genuine safety risk, including dangerous behaviour, refusal to follow safety instructions or suspected impairment. We will explain the reason for stopping and discuss appropriate next steps. Any charges for loss or damage arising from a participant's conduct will be considered according to the circumstances and applicable law; these terms do not create an automatic obligation to pay for every vehicle fault or incident.
10. Assessment, tests and licensing outcomes
Training is intended to help learners develop skills, but a passing result, licence upgrade, Statement of Attainment or employment outcome cannot be guaranteed. Progress and training hours vary with individual experience and competency.
TMR determines licensing eligibility and issues licences. Where a TMR test is involved, bookings and outcomes depend on TMR requirements and availability. For applicable nationally recognised training, the RTO is responsible for assessment and any Statement of Attainment, subject to successful completion and required records.
A further lesson, assessment attempt or third-party test may involve an additional disclosed fee. Learners have access to relevant review, complaint and assessment-appeal pathways.
11. Personal information and records
We collect and use personal information to respond to enquiries, organise training, communicate about bookings, take payments and meet legal and operational obligations. We may need to share relevant information with TMR, RAISE Training or other authorised parties in connection with enrolment, training, assessment or licensing.
Please read our Privacy Policy for information about personal data, service providers, access, corrections and privacy enquiries. Any promotional use of a learner's photograph or testimonial will require appropriate permission.
12. Website information and links
We aim to keep website information accurate, but course details, availability, eligibility rules, prices and government processes may change. If information differs, we will confirm the applicable details before a booking is finalised. External links are provided for convenience; their content is controlled by the relevant third party.
Website material, including original text, graphics and branding, must not be copied or commercially reused without permission, except as allowed by law.
13. Consumer guarantees and liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including applicable guarantees that services will be provided with due care and skill and be fit for a disclosed purpose. Depending on the circumstances, you may be entitled to a remedy such as a repeat service, cancellation, refund or compensation.
Nothing in these terms excludes, restricts or modifies a consumer guarantee or other right or remedy that cannot lawfully be excluded. To the extent permitted by law, we are not responsible for loss caused solely by circumstances outside our reasonable control, but this does not override any right you have under the Australian Consumer Law.
14. Complaints and concerns
If you have a concern about a booking, payment, training experience or service, please contact iTrain using the details below. We will consider the matter fairly, seek any necessary information and respond within a reasonable time.
For complaints about nationally recognised RAISE Training courses, including assessment decisions, learners may use RAISE Training's complaints and appeals processes in addition to contacting iTrain. You may also seek help from the relevant consumer protection or regulatory body where appropriate.
15. Changes to these terms
We may update these website terms from time to time by publishing an updated version. The terms presented and agreed at the time of a booking, together with the booking confirmation and any applicable RTO enrolment terms, will generally govern that booking unless a lawful change is agreed. We will not use an updated website version to retrospectively remove statutory rights.
16. Governing law and contact
These terms are governed by the laws of Queensland, Australia, subject to any applicable Commonwealth law.
